GENERAL TERMS AND CONDITIONS OF ATLAS BY BANK MUAMALAT BERHAD
These General Terms and Conditions (hereinafter referred to as “Terms”) govern the use of the digital banking services provided by ATLAS by Bank Muamalat Malaysia Berhad (“ATLAS”). By accessing and using our digital banking services, you (hereinafter referred to as “Customer” or “you”) agree to comply with and be bound by these Terms.
Please carefully read these Terms before using our services, as they affect your rights and obligations. By proceeding, you confirm that you have understood and accepted these Terms. Should you have any questions or require further clarification, kindly reach out to our Customer Service Team.
These Terms may be updated periodically, and any changes will be communicated through appropriate channels. Continued use of our digital banking services after such updates constitutes your acceptance of the revised Terms.
Please carefully review these Terms before using ATLAS or participating in any of its digital banking campaigns or promotions. Understanding these Terms is essential for your use of ATLAS.
These Terms govern your access, subscription, and use of ATLAS Please read them carefully, along with our Personal Data Protection Notice, before proceeding. By clicking “ACCEPT,” you agree to be bound by these Terms. If you disagree with any part, please refrain from using ATLAS.
Definition:
“ATLAS” refers to the ATLAS by Bank Muamalat Malaysia Berhad services or the Bank’s Digital banking services;
”Account(s)” means a saving, current, financing, fixed term, gold, credit card account, or any other active accounts which you may have with the Bank or relevant member of its Group which may be accessed via ATLAS application;
“ATLAS Application” refers to the online banking platform provided by Bank Muamalat Malaysia Berhad, known as ATLAS.
“Agreement” means ATLAS by Bank Muamalat Malaysia Berhad banking agreement herein, as may be varied with prior notice by the bank from time to time, the agreement;
“ATLAS Web Banking” refers to ATLAS secure online web base that allows users to access their accounts, transfer funds, pay bills and conduct other banking transactions.
“The Bank” refers to BANK MUAMALAT MALAYSIA BERHAD (Registration No. 196501000376 (6175-W)), a company incorporated in Malaysia with its registered office at Tingkat 30, Menara Bumiputra, Jalan Melaka, 50100 Kuala Lumpur, Malaysia and includes its subsidiaries and their successor in title and assigns and where applicable any of them.
“Business day” refers to days on which the Bank is open for business, excluding public holidays
“Group” refers to the Bank, including any current or future entities within its corporate group that share common ownership or control, either directly or indirectly.
“Internet” represents a global network of information transmitted to computers and devices, facilitating telecommunications systems.
“Instruction(s)” refers to any request, instruction, application, or authorization related to Accounts or Services communicated through ATLAS, in any form or transmitted via computer internet systems, mobile devices, or any other available electronic medium, shall be considered valid when accompanied by the applicable Access Codes. Unless the context indicates otherwise, this includes instructions communicated by you to the Bank via any other methods pertaining to ATLAS, including instructions in the form of files containing multiple instructions relating to several transactions.
“Password” A unique string of characters, created and managed by you, used for registration and ongoing access to the ATLAS application.
“Payee Corporation” ATLAS enables bill payments to corporations or other approved entities. These entities may include billing corporations or organizations designated by the Bank. Customers can use ATLAS to conveniently pay their bills.
“Sales Tax” A single-tier tax imposed on imported and domestically produced goods, typically levied either upon importation or at the point of sale or distribution by the manufacturer.
“Sale Tax Law” refers to the Sales Tax Act 2018 and its related regulations, as amended.
“Service(s)” refers to the Bank’s products and services accessible via the ATLAS platform, as detailed in Clause 8.0 or subject to future changes
“Transfer(s)”” has the meaning as described to it in Clause 11.0 herein:
“You” refers to the customer of the Bank or relevant member of its Group, who accesses, subscribes to and utilizes the ATLAS application;
- Account Creation Requirements
- To create an account with ATLAS, you must meet our eligibility criteria which are 18 years old and above, MyKad holder and Non – US citizen, subject to changes by the Bank. ATLAS may verify your identity using the DuitNow ID National Addressing Database. You also agree to provide any necessary information or documents we request in the specified format. ATLAS always reserves the right to reject or accept applications that do not meet ATLAS account creation requirements.
- You acknowledge the Bank’s obligations to conduct due diligence reviews of customers. You agree to provide necessary declarations, documents or information within specified timeframes. Failure to comply may result in us rejecting your account application. The Bank may verify your information through various sources, including credit reference agencies, tax authorities, and financial institutions. This information may be used for account creation, ongoing account management, debt recovery, or other purposes as required by law or regulation.
- Instruction
- Instructions to the Bank must be submitted in writing, either through any accepted means (including electronic methods) or other channels approved by the Bank. These instructions will only take effect once they have been received and verified by the Bank.
- The instructions given to the Bank must be from you only you hereby authorized the Bank to act and rely on any instructions from you. You acknowledged that the Bank may implement security verification to verify your identity and authorize the transactions. If requested, you must promptly provide necessary information or authentication. However, the Bank may execute an instructions without requiring such verification.
- You must be able to give instructions and to be responsible for the accuracy of the instructions given. The Bank may act on instruction based on its reasonable interpretation and you hereby indemnify the Bank for any delays due to unforeseen factors, losses or damages arising from such actions, unless such losses or damages are attributable by the Bank’s gross negligence, willful misconduct and fraud.
- Despite the above, the Bank may:
- decline any instructions that is unclear, incomplete, or contradicts previous instructions given by you; or
- request for more details or confirmation before carrying out your instructions.
- You acknowledge and agree that the Bank will not be responsible and liable for any transaction or instructions, or any failure to execute, implement, or complete a transaction or instruction, due to the following reason(s):
- Your account(s) or any other relevant account have insufficient funds to cover these instructions;
- There is an error in the instructions or information you provided, either during transmission through ATLAS or otherwise;
- Your account may be subject to legal processes, restrictions, or suspension, closure, or freezing for any reason;
- The Bank believes that you may have committed or are attempting to commit fraud or any other crime;
- The Bank believes there is a suspicion of any tampered instrument/instructions/fraudulent transaction, whether with/without your involvement or;
- You fail to follow any instructions, directions, guidelines, or procedures for using ATLAS or any part of it; or
- The Bank have reasonable grounds to do so for any other reason.
- Further to clause 2.5(e) above, the Bank reserves the right to decline any instructions that do not align with its policies, violate current regulations, or pose a security threat. This includes, but is not limited to, instructions that are fraudulent, illegal, or inconsistent with the Bank’s risk management guidelines. The Bank may also refuse to process instructions that are deemed to be excessive, unusual, or suspicious in nature. Ultimately, the decision to accept or reject an instruction is up to the Bank’s discretion.
- The Bank will carry out your instructions within a reasonable timeframe, considering the Bank’s current systems, operations, and prevailing circumstances.
- All instructions you provide will remain valid and enforceable for payments or actions executed in good faith, even in the event of your deaths, bankruptcy, winding-up, or revocation of such instructions, until the Bank receives formal written notice along with the necessary supporting documents evidencing such event.
- In an event where the service of a third party is required to complete a specific request, you hereby consent to the appointment of the third party by the Bank. However, you understand that we do not endorse or guarantee the third party’s ability to fulfil your instructions. The Bank will not be responsible for any losses or damages that you may occur due to the appointment of the third party or their actions, unless such losses or damages are attributable by the Bank’s gross negligence, wilful misconduct or fraud. We are also not responsible for any delays or lost communications between us and the third party.
- Your Commitment
- You guarantee the accuracy of the information provided when opening an account or using Bank services. To prevent unauthorized access, you must adhere to the following security measures:
- You must be responsible in safeguarding the application and the login details related to it from any other person, including ATLAS representative;
- You must take all reasonable precautions to keep safe the application from any unauthorized access;
- You are advised to never leave the application unattended as other may access the account details;
- The ATLAS application should be downloaded, installed and accessed by you in the mobile device via IOS, Android or any mobile devices as determined by the Bank from time to time;
- You are accountable for safeguarding the mobile device and ensuring that the use of the ATLAS application is secure, including protecting against unauthorized access through biometric identification; and
- You must adhere to the security measures outlined in the application, including this Agreement.
- You warrant and agree to the following:
- Adhere to all relevant laws, including those related to Foreign Account Tax Compliance Act (FATCA), Common Reporting Standard (CRS), taxation, bribery and corruption, money laundering, terrorism financing, and sanctions.
- not to use our services for any illegal purpose or to violate any applicable laws, including those related to money laundering, terrorism financing, or sanctions. Additionally, you will not allow others to use our services for these purposes.
- Promptly review your statements, transaction notifications, and alerts upon receipt. Report any errors or unauthorized transactions immediately. Provide any requested information to assist in our investigations. If necessary, file a police report to facilitate claims investigations. Explain any delays in reporting errors or unauthorized transactions.
- Biometric verification, like face recognition and fingerprint scanning, relies on your device’s built-in security features. The Bank does not guarantee the security of these features on your device. The Bank is not responsible for any unauthorized access to the ATLAS application that occurs through your device’s biometric identification.
- ATLAS may temporarily suspend your access to the application if there are any problems or inconsistencies with your account, such as fraud, unauthorized disclosure, misuse, suspicion of any tampered instrument/instructions/fraudulent transaction, whether with/without your involvement.
- ATLAS will not ask for your personal information, password, passcode, or other security codes via phone call, SMS or email. You must at all times keep such information confidential and shall not share or disclose the information to any person whatsoever. Always be cautious of any links in messages claiming to be from the Bank. Verify their authenticity before clicking on them.
- You guarantee the accuracy of the information provided when opening an account or using Bank services. To prevent unauthorized access, you must adhere to the following security measures:
- Statement and notification
- The Bank will provide access to your account statements and transaction history through the ATLAS application. You may view, save, and print these statements in PDF format
or other formats made available by the Bank. The Bank may also send you notifications of transactions on your account, regardless of the transaction amount. - You are responsible for reviewing your account statements and transaction notifications for errors or unauthorized transactions. By using the ATLAS application and ATLAS Web banking you acknowledge that you will promptly examine any statements or notifications upon receipt. Kindly ensure the ATLAS application is given permission for pop-up notifications at all times. If you fail to receive transaction notifications due to disabling pop-up notifications in ATLAS, the Bank will not be liable for any losses or damages.
- Pursuant to clause (4.2) above, the Bank may deem the information provided in the statement of account as correct, accurate, conclusive, and binding upon you if:
- the Bank does not receive any notification from you regarding errors or unauthorized transactions; or
- you fail to object to any details included in your statement of account within fourteen (14) days from the date such statement becomes available to you.
- The Bank reserves the right to adjust, reverse or cancel any transaction or entry in your account statements or records at any time if necessary to correct errors, omissions, return wrongfully credited funds, or ensure that cleared or unconditional funds are received in full and on time. Any such adjustments will be binding on you.
- The Bank will provide access to your account statements and transaction history through the ATLAS application. You may view, save, and print these statements in PDF format
- Fees and Service Charges
- In addition to any applicable fees and charges associated with your account(s), please be aware that the Bank may impose fees, commissions, or other charges related to specific services or features.
- Pursuant to the Terms, all fees, commissions, charges, and other payments shall be subject to applicable Sales Tax as defined by the Sales Tax Law, unless otherwise specified.
- The Bank will provide you with at least twenty-one (21) calendar days prior notice for any changes towards fees, charges, or variations thereof, in accordance with the applicable notice clause. If you disagree with the imposition of such fees, charges, or variations, you should discontinue using the relevant service. Your continuous use of the service or issuance of instructions related to a particular transaction will be considered as acceptance of the applicable fees, charges, or variations.
- You acknowledge and agree that the Bank reserves the right to debit your relevant Account for the payment of any fees, charges, and/or penalties imposed pursuant to these Terms, including any Government charges, stamp duties, or taxes payable as a result of the use of ATLAS products and the services provided thereunder. Such fees and charges shall be paid to the Bank within the time and manner prescribed by the Bank.
- In the event there is insufficient available balance in the Designated Account to pay for any Transaction or other amount payable by you, including any profit, fees, charges or other payment due to the Bank, the Bank reserves its absolute right to set-off any credit balance in one of your accounts by giving you seven (7) calendar days’ notice prior to the effective date.
- You understand and agree that all fees and charges associated with your access to the Bank’s online services, including but not limited to telephone, telecommunication, and internet service provider fees, are your sole responsibility. The Bank shall not be liable for any such charges.
- For all bill payment and prepaid transactions, if you require a valid tax invoice, please contact the relevant payee corporation or telecommunications company directly.
- All service charges, including applicable sales tax, are non-transferable and nonrefundable unless otherwise specified in the Bank’s Terms.
- Disclosure of Customer Information and Personal Data under The Islamic Financial Services Act 2013(“IFSA”) and the Personal Data Protection Act 2010 (“PDPA”)
Subject to the following provisions, and if refuse to by you or requires you to express consent for the disclosure of your information to third parties for facilitating the Bank’s business, operations, facilities, or services, you consent and authorize the Bank to collect, process, disclose, transfer, maintain, store, and retain your personal data with other entities within the Bank, including its subsidiaries, and external parties, including but not limited to those listed in clause 6.1 below.- You consent and agree to the Bank conducting credit checks and verifying the information provided in your application for banking accounts or services with any credit bureaus or corporations established for collecting and providing credit or other information. You also consent to the Bank disclosing your financial condition, account details, account relationship with the Bank, including credit balances to:
- Government or regulatory authorities in Malaysia and elsewhere, including Bank Negara Malaysia, Credit Bureau, Central Credit Reference Information System (CCRIS), Cagamas Berhad, Credit Guarantee Corporation Malaysia
Berhad; - Companies which are related to the Bank by virtue of Section 7 of the Companies Act 2016, or any associated company of the Bank.
- party(ies) providing services (including outsourcing vendors, lawyers, nominees, custodians, centralised securities depository or registrar, debt collection agents) to the Bank.
- the Bank’s agents, consultants and professional advisers.
- the police or any investigating officer conducting any investigation; and
- any person to whom disclosure is permitted or required by any law, regulation, governmental directive or request.
- Government or regulatory authorities in Malaysia and elsewhere, including Bank Negara Malaysia, Credit Bureau, Central Credit Reference Information System (CCRIS), Cagamas Berhad, Credit Guarantee Corporation Malaysia
- The Bank may, subject to compliance with the applicable regulatory rules or guideline, use or apply any information related to you, collected, compiled, or obtained by the Bank through any means, for purposes as determined by the Bank, subject to applicable regulatory requirements.
- You agree that the Bank’s employees, representatives, and/or agents may contact you from time to time through oral communication, including but not limited to email, SMS and telephone call regarding products or services promotions, unless you object in writing.
- You declare that all personal information provided in this document is/are true, accurate, and up to date. If there are any changes to your personal information, you shall notify the Bank immediately.
- You consent and agree to the Bank conducting credit checks and verifying the information provided in your application for banking accounts or services with any credit bureaus or corporations established for collecting and providing credit or other information. You also consent to the Bank disclosing your financial condition, account details, account relationship with the Bank, including credit balances to:
- Account information
- The Bank does not warrant for the accuracy of any information regarding transactions, your account(s), or other relevant accounts that may be reported through or accessed via ATLAS.You acknowledge that information regarding transactions, your accounts, or any other relevant accounts, as reported through or made available via ATLAS, may not always be entirely current. This is due to transactions or instructions that, among other things, have been provisionally credited as uncleared effects (subject to reversal if not cleared), are pending processing, require verification by the Bank, Payee Corporations, receiving financial institutions, or third parties, or are in progress. You specifically agree that such information should not be considered conclusive for any purpose related to your transactions, accounts, or balances.
- Confidentiality and Security of Customer Information File (CIF)
- The Bank’s rights to your information File (CIF), including your transactions, accounts, or any other applicable accounts (collectively “your information”), is governed by our Privacy Policy, available on our ATLAS Banking website. This policy outlines our principles for using and sharing your information with third parties. By agreeing to these Terms, you confirm that you have reviewed and understood our Privacy Policy and consent to such disclosures. The Bank, its officers, and officials shall not be liable for
any loss or damage you suffer due to the disclosure, divulgence, or revelation of your information in accordance with our Privacy Policy, except in cases of fraud or gross negligence on the bank’s part. The bank is authorized to make such disclosures. - Subject to these Terms, the Bank will use its best efforts to ensure that all information transmitted or received through ATLAS services is secure and inaccessible to unauthorized third parties, consistent with our Privacy Policy, available on our ATLAS Banking website.
- If you suspect that their mobile devices or associated security credentials have been compromised, they must immediately notify the Bank within five Business Days. You agree to fully cooperate with the Bank and any relevant authorities in investigating such incidents.
- The Bank’s rights to your information File (CIF), including your transactions, accounts, or any other applicable accounts (collectively “your information”), is governed by our Privacy Policy, available on our ATLAS Banking website. This policy outlines our principles for using and sharing your information with third parties. By agreeing to these Terms, you confirm that you have reviewed and understood our Privacy Policy and consent to such disclosures. The Bank, its officers, and officials shall not be liable for
- Change in Terms
- The Bank reserves the right to amend, modify, or update these Terms at any time. Any changes will be communicated to you through appropriate channels, such as email, ATLAS application notifications, or by posting the updated terms on the Bank’s website or digital platforms.
- Changes will take effect on the date specified in the notice or immediately upon publication if no date is provided. By continuing to use the Bank’s services after the terms have been updated, you agree to be bound by the revised terms.
- If you do not agree with any changes, you must notify the Bank in writing and discontinue using the services before the changes take effect.
- Payment and Transfer
- You should ensure that all relevant consents and authorizations are obtained for the issuance of the payment and transfer Instructions and for such Instructions to be carried out;
- You acknowledge and agree that all payments and transfers are subject to such limits or conditions imposed by the Bank, the relevant payee, receiving financial institution, or any other applicable third party.
- You may set your own limits for transfers.
- You are responsible for ensuring that all payments and transfers comply with the procedures and requirements specified by the relevant payee corporation, receiving financial institution, or any other applicable third party.
- You are responsible for adhering to all procedures and deadlines set by the relevant payee corporation for settling payments. The Bank shall not be liable for any consequences arising from your failure to comply with these requirements.
- You acknowledge that transfers to your own account or the accounts of third parties at other financial institutions are subject to the Terms of those institutions. The availability of transfer services to accounts at other banks may vary and is determined by ATLAS from time to time.
- You acknowledge and agree that Payments and Transfers will only be authorized to Payee Corporations or receiving financial institutions or entities approved by the Bank. The Bank is not liable for any losses or damages arising from Payment or Transfer Instructions involving unapproved Payee Corporations or financial institutions, even if they were approved at the time the instruction was issued but were later removed from the Bank’s approved list.
- You must notify the Bank of any changes to the registered details and particulars with the relevant Payee Corporation, as well as any changes to your accounts or those of any relevant beneficiaries held with the Payee Corporation, before issuing any Payment Instructions.
- You acknowledge and agree that the Bank is not obligated to verify the accuracy of any details, particulars, account numbers, or identities of any account holder with any payee corporation, receiving financial institution, or entity. The Bank shall not be responsible or liable for any loss or damage arising from the rejection or non-acceptance of any such payments or transfers by such payee corporation or receiving financial institution or entity.
- You acknowledge and agree that any payment or transfer instructions will be subject to further processing by the relevant payee corporation or receiving financial institution. The Bank will not be responsible for any losses or damages arising from delays, errors, or failures in processing such transactions by these entities.
- ATLAS Liabilities
- You acknowledge and accept the inherent risks associated with conducting transactions through the internet. You understand that electronic communications may not be received as intended or may be delayed and agree that ATLAS shall not be liable for any losses or damages arising from such circumstances.
- You acknowledge that to the extent permitted by law, ATLAS and its affiliated entities make no warranties or representations of any kind with respect to ATLAS, whether express or implied, including but not limited to merchantability or fitness for a particular purpose. Neither ATLAS, its affiliated entities, nor any other parties involved in the creation, production, or delivery of ATLAS assume any responsibility for your use thereof. No oral or written information or advice given by ATLAS, its affiliated entities, or ATLAS’s employees shall create a warranty or in any way increase the scope of this warranty, and you may not rely on any such information or advice.
- The Bank shall not be liable for any losses or damages incurred by You or any third party due to the use of ATLAS, except in cases of the Bank’s fraudulent or grossly negligent conduct.
- Without limiting the generality of the foregoing, ATLAS shall not be liable for any loss, damage, or inconvenience incurred by You due to or arising from:
- The Bank’s processing of Your Instructions based on its interpretation of the same;
- Your own breach of these Terms or any applicable requirements or guidelines imposed from time to time;
- any failure on Your part to adhere to the updated instructions, procedures, guidelines, and directives for using ATLAS;
- Your inability to complete any transactions due to limitations imposed by ATLAS or any applicable third party;
- any destruction or alteration of your instructions or any other instruction, data, information, or communication transmitted by you to ATLAS;
- any errors in the transmission of Your Instructions or other instructions, data, information, or communications transmitted by You to the Bank, or errors in the Bank’s transmission of any data, information, or communications through
ATLAS; - The ATLAS Digital Banking Service or any of its features being unavailable or inoperative;
- any breakdown or malfunction of any equipment, system, or software used in connection with ATLAS, including but not limited to any electronic terminal, server or system, telecommunication device, connection, or system or any part of the system;
- any unauthorized access or attack by any individual, hardware, software, virus, Trojan horse, worm, macro, or other malicious component that may disrupt or compromise ATLAS;
- any malfunctions of your computer system(s), mobile device(s), terminal, access device(s), related facilities, or other software belonging to or operated by you;
- any failure or delay caused by browser software, mobile device application stores, computer viruses, or related issues attributable to services provided by Internet Service Providers or other software providers;
- Your access to and/or use of ATLAS may be prohibited, restricted, delayed, or otherwise affected by the laws and regulations of the country from which you access ATLAS; or
- any loss or damage caused by third parties or due to circumstances beyond the Bank’s reasonable control, including acts of God;
You acknowledge that each sub-clause of this Agreement is a separate limitation that applies and remains in effect, even if any other provision becomes inapplicable or is deemed unreasonable. These limitations will continue to apply, regardless of whether your account(s) or ATLAS itself is terminated or modified.
- In no event shall ATLAS’s liability, whether in contract, tort, or otherwise, arising from or in connection with these Terms or the provision of ATLAS services exceed the amount of the transactions giving rise to the claim or the direct damages sustained, whichever is lower.
- In addition to and without limiting any other rights or remedies available to ATLAS under this Agreement or otherwise, you agree to indemnify and hold ATLAS harmless from and against any and all losses, damages, or expenses incurred by ATLAS as a result of any of the following:
- Any failure by You to comply with any of these Terms; or
- The Bank will act in accordance with your instructions transmitted via the Bank’s Customer Service Care Line as otherwise provided in these Terms.
- Unforeseen Circumstances: ATLAS will not be liable for any failure to comply with the Terms due to the following reasons:
- Due to unforeseen and extraordinary circumstances beyond ATLAS’s control, the consequences would have been inevitable, despite all efforts to mitigate them.
- where the Bank’s failure to comply is attributable to legal or regulatory obligations.
- Notice
- You are responsible for providing accurate and up-to-date contact information, including your residential address in Malaysia, phone number, and email address. This information will be used for official correspondence and notifications. Any changes to your contact information should be informed to us immediately.
- You hereby consent to all notices and other communications related to ATLAS or required under these Terms being provided by the Bank in any one or more of the following ways:
- By ordinary post to your last address in the record with ATLAS. Such notification shall be deemed received two (2) days after the date of mailing.
- By including a notice in your ATLAS account statement (as applicable), we will consider the notification effective two (2) business days after the date it appears on your statement.
- Sending a notification through the ATLAS App, which will take effect upon your next login to ATLAS after the notification is sent, as recorded by the Bank d) By email to the last known email address provided by You in the Bank’s records. Such notification shall be deemed received twenty-four (24) hours after sending; or
- By providing you with a notification in any manner deemed appropriate by the Bank
- All notices received from You will only be effective upon our acknowledgment of receipt and formal recording in our records.
- Suspension or Termination of Service
- You may terminate your ATLAS account by providing written notice via email to the Bank or by contacting our Customer Service Care Line. The ATLAS account will be cancelled within seven (7) Business Days from the date the Bank receives request from you. You agree not to use ATLAS to execute any instructions received after the date the Bank receives your notice of termination.
- Notwithstanding the foregoing, the Bank shall not be liable for your continued use of ATLAS after receiving your written notice of termination. The Bank is not responsible for any transactions or instructions executed or processed after the receipt of such notice.
- ATLAS reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to all or any portion of ATLAS services at any time. ATLAS shall not be liable for any loss or damage incurred as a result of such action. Subject to the foregoing, the Bank may terminate, suspend or restrict your access to ATLAS by giving you twenty-one (21) calendar days’ prior notice if:
- You breach any term, condition or provision of these Terms or laid down by any legal, regulatory or other authority or body relevant hereto
- You fail to pay any fees or charges when due; or
- You or persons purporting to be You has provided the Bank with false or incomplete information for the access to or use of the ATLAS.
- You hereby agree that the Bank reserves its right to: –
- Close any Banking Account(s) if your name appear(s) in the Blacklist issued by the Credit Bureau, Bank Negara Malaysia by giving you fourteen (14) day’s notice of such intention.
- Close any Banking Accounts for any reason whatsoever by giving fourteen (14) days’ notice of such intention and the Bank shall not be bound to disclose any reasons thereof.
- You acknowledge and agree that if your access to ATLAS is terminated for any of the reasons mentioned above, the Bank shall not be liable for any failure to carry out, implement, execute, or process any transactions or instructions received prior to such termination and remaining unprocessed at the time of termination by the Bank or otherwise at the time of receipt of your notice to terminate.
- You acknowledge that termination of your relationship with ATLAS will not affect your liability or obligations for any instructions previously processed by ATLAS on your behalf.
- All Terms that are intended to persist beyond the expiration or termination of these ATLAS Terms, explicitly or implicitly, will remain in effect even after the Agreement’s conclusion, regardless of the reason for its termination.
- Evidence
- You acknowledge and agree that, absent a manifest error and without prejudice to Clause 7, all evidence of Instructions received or transactions executed by ATLAS and/or communications transmitted between ATLAS and you, including any evidence in the form of, among others, computer printouts, transaction logs, telephone logs, magnetic tapes, cartridge, and any other form of information and data storage, shall be binding on you and treated as conclusive evidence of your Instructions, transactions, and the communications between ATLAS and you for all purposes.
- All electronic instructions or communications sent to or by ATLAS that comply with ATLAS’s operating standards and requirements will be considered legally binding and equivalent to written or signed documentary communications.
- Intellectual Property and Proprietary Rights
You acknowledge and agree that all intellectual property and proprietary rights in and to the Bank’s computer systems and the ATLAS, including, without limitation to ATLAS application, web banking and all contents and any updates thereof, are owned exclusively by the Bank or members of its Group or the relevant third-party vendor, affiliate, or any other third party, as applicable. - Enquiries and Dispute

- If you have any concerns or disputes related to ATLAS or the Terms governing your account, please contact ATLAS Customer Service at the address provided above. Please clearly state the nature of your complaint or dispute.
- ATLAS will, upon receipt and acknowledgement of your complaint or dispute, allocate resources to investigate and resolve the matter based on all available evidence.
- Where based on our investigation, ATLAS has determined that you are responsible for any losses incurred due to the misuse, theft, or unauthorized use of your approval code. We will provide you with copies of relevant documents and evidence from our investigation, including information from our transaction and system logs. Please note that we may not disclose information that directly relates to or compromises the security of ATLAS or its systems, or that violates the confidentiality of information pertaining to other customers.
- You have the right to appeal against the outcome of any complaint or dispute to the Ombudsman for Financial Services or the ATLAS Customer Service. This process is outlined in the ATLAS Customer Service Charter, which is available on our website.

- Waiver
- No failure or delay on the part of the Bank in exercising nor any omission to exercise any right, power, privilege or remedy provided in the Terms and Conditions shall constitute a waiver or acquiescence of such default which shall affect or impair any right, power, privilege or remedy herein.
- Law and Jurisdiction
- These Terms shall be governed by and construed in accordance with laws of Malaysia.
